"After his arrest, Vasey announced his plans to launch a charter challenge to the regulation.  Morton said he is confident his client would have been successful in defending himself against the charges had they stuck.  He said it is rare for charges to fall through the cracks due to clerical errors but said it’s possible Toronto police may have failed to properly file Vasey’s charges."  (link)

So now the challenge cannot be mounted because the unconstitutional charges mysteriously got lost on the way to the courtroom?  How convenient!  Now no one has standing to tell the Premier that he can't invent a law in secret and then instruct the police to arrest people under a law that was never passed and wasn't scheduled to be published until after it had expired.

Really, if a Premier can create laws all by himself, why do we have a Provincial Parliament?  We should close the thing down and save lots of money!  Just declare Dalton McGuinty to be Ontario's dictator and be done with it.  Singapore seems to do just fine with dictatorial government, as does Python (BDFL).  But according to the "Canada's Government" section of the citizenship exam that I'll need to take soon, that's not how things are supposed to be done here.
